CNN —A pro-Trump lawyer who tried to overturn the 2020 election was arrested Monday after a court hearing about her recent leak of internal emails belonging to Dominion Voting Systems. In the last 24 hours, Leaf has posted more than 2,000 internal Dominion documents on his social media account. The marshals declined to say whether they arrested her, and she didn’t answer messages seeking comment after the hearing. During the at-times testy hearing Monday, Magistrate Judge Moxila Upadhyaya peppered Lambert with sharp questions about the disputed Dominion materials. Dominion wants Lambert removed from the case and suggested in court Monday that she might have committed a crime by disseminating the files to Leaf.

Washington CNN —Vice President Kamala Harris said Friday that it is “absurd” and “patently unfair” that marijuana is treated the same as heroin and other Schedule I drugs – and more seriously than fentanyl – under federal law. “Marijuana is considered as dangerous as heroin and more dangerous than fentanyl, which is absurd, not to mention patently unfair,” Harris said during a roundtable on the administration’s plans for cannabis reform. The administration began the process of reconsidering how marijuana is treated under federal law just before the midterms in 2022. Andy Beshear - and alluded to her own role in what she described as an unequal criminal justice system. Harris’ own feelings on marijuana reform have evolved in line with her career.

CNN —The former FBI informant charged with lying about the Bidens’ dealings in Ukraine told investigators after his arrest that Russian intelligence officials were involved in passing information to him about Hunter Biden, prosecutors said Tuesday in a new court filing, noting that the information was false. They said he previously told the FBI that he has longstanding and extensive contacts with Russian spies, including individuals he said were high-level intelligence officers or command Russian assassins abroad. The story, prosecutors noted, matches the story Smirnov told his handler about Hunter Biden being recorded in a foreign hotel. And, prosecutors wrote, Smirnov claims to have met with Russian intelligence officials as recently as November and December 2023. “He is actively peddling new lies that could impact U.S. elections after meeting with Russian intelligence officials in November.

CNN —Donald Trump is not immune from prosecution for alleged crimes he committed during his presidency to reverse the 2020 election results, a federal appeals court said Tuesday. The ruling is a major blow to Trump’s key defense thus far in the federal election subversion case brought against him by special counsel Jack Smith. “For the purpose of this criminal case, former President Trump has become citizen Trump, with all of the defenses of any other criminal defendant. But any executive immunity that may have protected him while he served as President no longer protects him against this prosecution,” the court wrote. Not protected under separation of powers clauseThe appeals court found that Trump is not protected from criminal prosecution under the separation of powers clause.

☆ House Judiciary GOP subpoenas assistant US attorney involved in Hunter Biden probe

CNN —The House Judiciary Committee has subpoenaed an assistant US attorney on the Hunter Biden criminal case, according to a copy of the subpoena reviewed by CNN. House Judiciary Chairman Jim Jordan initially requested testimony from Assistant US Attorney Lesley Wolf in June along with a number of Justice Department officials involved in the Hunter Biden criminal investigation. The Department of Justice has made six high-level officials, including special counsel David Weiss, available to testify, but has not allowed the panel to interview Wolf. In the subpoena letter, Jordan called the DOJ’s reasons for withholding Wolf’s testimony “unpersuasive.” DOJ declined to comment to CNN on the subpoena. During his closed-door interview with Congress earlier this month, Weiss defended Wolf.
